Following several years of litigation, a Benicar settlement was announced by the makers of the popular blood pressure drug on August 1, 2017, offering financial compensation for certain individuals who experienced gastrointestinal problems, such as:

  • Chronic Diarrhea
  • Nausea, Vomiting and Weight Loss
  • Villous Atrophy
  • Misdiagnosis of Celiac Disease

The agreement to settle Benicar cases comes following several years of litigation in the federal court system, where more than 2,000 lawsuits have been filed against Daiichi Sankyo and Forest Laboratories over the failure to adequately warn consumers and the medical community about the link between Benicar and chronic diarrhea symptoms.

Under terms of the settlement offer, the drug maker will pay $300 million in financial compensation to resolve claims involving certain injuries stemming from the use of Benicar prior to May 2015.

For individuals who have not yet filed a lawsuit over Benicar gastrointestinal problems experienced following use of the drug, there may still be limited time to pursue financial compensation. The settlement requires that any unfiled claims have a signed retainer agreement with an attorney before 11:59 pm Eastern Daylight Time on August 23, 2017.

The Benicar lawyers at Saiontz & Kirk, P.A. are continuing to provide free case evaluations for individuals who suspect that they may qualify for a settlement. However, limited time remains to obtain the necessary information to pursue a case, and meet various deadlines outlined in the Benicar settlement agreement.

A court-ordered census for all filed and unfiled claims must be filed by August 25, and the deadline for the Benicar injury settlement will require eligible plaintiffs to submit an “Opt In Package”, with at least 95% of all claimants agreeing to accept the offer before the settlement will be finalized. Therefore, it is important that immediate steps be taken if you believe that you or a loved one may be eligible to settle a Benicar injury claim.

After August 17, 2017, Saiontz & Kirk, P.A. will no longer be providing free consultations or reviewing additional Benicar claims.

    Why must the client be responsible for ur legal fees? Shouldn’t the drug manuf. pay ur fees as well any medical bills? Just wondering.

    I was hospitalized and was suddenly not able to eat and had a severe case of diahrhea my doctor thought I had sceliac disease. I was not allowed to eat soy, corn, wheat, or dairy. I lost feeling in my breast from time and my body was feeling numb in the stomach. I was very sick while I was on Bene car.

    My doctor had me on this medicine for some years. I just couldn’t understand every time I took the medicine my stomach hurts so bad. I even end up in the hospital several time due to this medicine. Now I have to take another medicine 4 times a day for my stomach. I can’t stay out of the bathroom. I have to watch what I eat too. Since taking this medicine I been so sick.

    I was on benicar since 2009 and had diarrhea every single day. I was nauseous every single day. I developed re-flux so bad that I couldnt sleep at night and had to be put on medication for that. I was dizzy all day long and woke up one evening and stood up and passed out and ended up in ICU with a brain bleed. I stopped taking the medication in late 2014 on my own and have never felt better.

    I was on benicar for a number of years in which has plagued my life with stomach problems from cramps to diarea to hospital visits to emergency rooms to get fluids because of dehydration from not being able to swallow food the nausea was embarable acid reflux and biohopsy numerous times because the doctors could not figure out my problems at all .also to being told you are going to have to have your stomach removed because it will not function properly to move you food out of it .to being put on an experimental drug that can only be bout in the u k because it is not fda approved and you insurance want cover it but still the battle goes on with mental and physical ability to cope with such a horrible way to live daily. It is so discouraging because what I have lost in life cannot be replaced so I just wanted to dhare what has happen to me through this drug it has been a nightmare still ongoing.

    Since I took benicar hct my stomach never been the same. My stomach hurts and I have to stay close by a bathroom. I even been hospitalized. I can eat dairy products. I lost my appitate. Now I am on other medicines for my stomach issues.

    I have been on this medication for 6 years, now at the present time I have had gallbladder surgery, cannot eat before I travel, I have diarrhea all the time, my stomach cramps so bad, I have to watch what I eat, now I am on stomach medicine, this is no way to have to live your life, you I am afraid to get far away from home, because I know what is coming, diarrhea.

    I’ve been on this medicine 6-7 years too. And can’t stay outta
    my bathroom either. I’ve gotten colitis from it and a host of
    other things. We should have been informed what a danger
    this drug was. I could have been dead by now? That medicine
    should’ve been taken off the market along time ago.

    I have been suffering with gastrointestinal problems for the last 4 years after being on Benicar. told the doctors I was having problems walking soreness around the waist and they would say it’s from old age or working to hard..I 65yr old did mechanic work for 10 years but did computer IT for 15 years..Don’t thonk that has anything to do with it. Still sore around the waist cannot walk right …now they have me on lisnopril and norvask…

    I’ve been taking benicar for about 3 years and have been suffering from hives all over my body and having really bad gas problems I’ve been to specialist for hives and allergy doctors 3 years and going. The hives all most MAKES me want to knock myself out because it’s like ants are bitting me all over my body 318

    For the woman that had her gallbladder taken out and now has severe diarrhea attacks you may be one of the 20%of people that had their gallbladder removed and now have a bile dumping syndrome. It is when the liver dumps bile so fast it causes diarrhea bouts that are quite sudden and usually happens after you have eaten something. It happened to me! I took a medication for a while called Welchol. It arrested t he attacks I was having with the first day I started on it. It was a miracle drug for me. Talk to your doctor. Get the prescription. I don’t have to take it as often anymore, in fact can’t remember t he last time I did,but I keep it on hand all the time and take it before we go on a trip out of town. Good luck!

    I stay nauseous most of the time. burp constantly, feel bloated, have diarrhea a lot of the time, feel terrible most of the time. I have had an endiscopy, went to my surgeon thinking I might need gallstone removal but the surgeon told me he thought my symptoms may be caused by some med I might be on. I have been on Benicar for seversl years but didn’t know this could possibly be my problem. I just read about the class action suit concerning the Benicar. I feel miserable most of the time and am thinking it could be this med. Since I just found out about this I am wondering if it is too late to be involved with this class action suit.

    I use to take the prescription drug for high blood pressure, and I had kidney problems, I had to have surgery on one of my kidney in 2011or 2012. I’m just hearing about this lawsuit allegations.

    Took for almost 10years had diarrhea twice daily lost 4 dress sizes was nausiated daily still have bouts of diarrhea am no longer on Benicar I was a test subject without my permission

    i understand all the conditions I have several different things I deal with like cramps so bad it is worse then when it decides to go away u have no energy ….loose stool and cant make plans unless u have a bathroom close cant eat with out meds it sucks and then there is GERD ya something I have to go to hospital for a lime/green liquid (yum) the heartburn that comes with all of this cause we were told BENICAR was safe….ok

    I have been taking Benicar for years. I have a lot of problems with my stomach. Had to have my gall bladder removed a little over two years. Never had stomach problem before! The Doctor had to do an emergency surgery on me.

    I was on Bencair for a year back in 2003 being trying too file my case since last year and couldn’t get anyone to take it. I suffer chronicle stomach pains on medicine for it.

    Am STILL on Benicar, been on since 2003. Same as rest bad cramps, had to get a GI done. Diarrhea, GOT bladder cancer since than. Thought i had the flu a lot when it wasnt the flu. Thought i had gall stones and DR, did the scope saying it wasnt gall stones but stomach problems,, Going to DR, NOW to get off Benicar.

    ive been on benicar for about 8 years..it was great for controlling my high blood pressure, but the whole time i took i was sick to my stomach, cramps , just this july i was in the hospital for 23 days, found out i was in kidney failure, i have to have dialysis 3 days a week for four hours at a time.I am only 46 years old and will have to have a transplant.

    I was taken this drug for 14 yrs and for pass 6 yrs I was suffering from anemia passing blood thru stool it would happen several times a month had to get several blood transfusion iron injection went thru test for years even been cut open to check my intestines but nothing
    I look up this drug and found that Benicar hct that some people had made clams of this also told my doctor of this and I took myself off of it the bleeding stopped and hasn’t returned for a year
